Carefully read your vacation agreement. Once you have reviewed the terms, you can sign your agreement, create a guest list, check payments received and print an invoice. 1 - Introduction

Thank you for staying with us. Please let us know what we can do to make your visit more enjoyable. Below we set forth the terms and conditions of your stay. Please consult our Welcome Guide for answers to common questions.

In addition to this vacation rental agreement, you agree to obey all township and/or village ordinances in regard to Short Term Rentals. Please consult these ordinances using these links.

Check In and Out: Check-In is 3:00PM; Check-Out is at 11:00AM promptly, unless prior arrangement is made.

1.1 - Included With Rental: Linens: Sheets, pillows and bedding, bath towels and washcloths are provided. Please do not use bath towels for the beach or as cleaning rags - please bring your own beach towels. Pantry Items: Toilet paper, paper towels and soap. If there are housekeeping issues at check-in please tell us immediately, not at the end of the stay, so we can remedy the situation (no discounts will be given at end of stay).

1.2 - Departure Responsibilities of Guests: Prior to departure, dispose of all trash, wash all dirty dishes, check laundry for forgotten clothing and return furniture to its original location. Leave the premises in a respectable order. Your cooperation is greatly appreciated.

  • Guest prossesions left behind are not the responsibility of owner/manager especially perishable items.
  • Guest will not be reimbursed for lost items, however owner/manager will try to return any found non-persihable items at guest's expense.
  • Guest agrees to fill out the guest list at anytime after signing the agreement. We use this to return lost items and/or comply with local ordinances.

1.3 - Damage or Loss to Premises: We understand accidents happen. We ask you to understand that we need to know when damage occurs. Please report any damage or loss promptly. We are not responsible for any loss, theft or damage to the property of any Guest, or for any injury to any Guest for the use of our premises or property. See Liability Release {8} for further explanation.

1.4 - Number of Guests: Guests are asked to provide an accurate guest count including day visitors. If the number of overnight guests changes at any time please notify the Manager beforehand. The maximum number of overnight guests (2+ Years and Older) are permitted to stay at the property, as indicated in {3.1 Occupancy}. Do not include infants in your guest count. If more overnight guests are reported or found in the property without our written consent, you will be assessed an additional fee equaling one-quarter of the rental cost and additional guests will be asked to vacate.

1.5 - Tobacco Use: Our property is 100% non-smoking and tobacco free, including the surrounding grounds. This policy is for safety, cleanliness, and the enjoyment of our other guests. Please ask your visitors and guests to comply with this policy. Any person found smoking or evidence of smoking voilates our Tobacco Use policy.

I understand that I may NOT use any tobacco products in the vacation rental or within its grounds. I understand and agree that failure to perform all above will result in forfeiture of Damage Deposit and/or additional surcharge of $500.

1.6 - Pets: Pets may be permitted with the prior written approval of the manager. There is a non-refundable fee for visiting pets, as indicated herein. Pet Fee should not be considered a cleaning fee. It simply grants you the right to bring a pet.

I hereby intend to bring my pet and agree to all guidelines set forth in the Pet Agreement {12}.

1.7 - Boats: Boats may be permitted with the prior written approval of the manager, however renting a marina slip is highly recommended. We provide no motor boats or small watercraft. Motor boats, jet skis, kayaks and paddleboards may be rented from local vendors. See our Welcome Guide for recommendations.

I hereby intend to bring my motor boat and agree to all guidelines set forth in the Boating Agreement {13}.

1.8 - Good Neighbor Rule: Our Guests are expected to be “Good Neighbors.” Please use common sense and courtesy in respecting other guests, and surrounding neighborsy. Please follow any Rules outlined in the Welcome Guide. Please let us know if neighboring guests interfere with your enjoyment of our Property.

1.9 - Entry of Premises: As necessary, an authorized employee or licensed repairperson may enter the premises for repair or management of the premises. Whenever possible, we will give you 24 hours notice.

1.10 - No Change to Premises: Guests are discouraged from rearranging furniture or decoratoring the property. If you do so, you promise to restore the property as you found it at check in.

1.11 - Expectations of Guests: Failure to comply with the terms and conditions in this “Vacation Guest Agreement” may result in a forfeiture of the reservation or termination of your stay without refund.

1.12 - Force Majeure: The "Owner" and our affiliates will not be liable for any delay or failure to perform any obligation under this Agreement where the delay or failure results from any cause beyond our reasonable control, including acts of God, labor disputes or other industrial disturbances, systemic electrical, telecommunications, or other utility failures, earthquake, storms or other elements of nature, blockages, embargoes, riots, acts or orders of government, acts of terrorism, or war.

1.13 - Sole Responsibility: The "Guest" signing this Agreement is responsible for all other listed guests and visitors actions at the rental. Guest is also responsible for any balance and charges including the Damage Deposit. Pet Fee, Cleaning Fee, or any Surcharges due.

1.14 - No Third Party Beneficiaries: This Agreement does not create any third party beneficiary rights in any individual or entity that is not a party to this Agreement.

1.15 - Assignment: The "Guest" will not assign this Agreement, or delegate or sublicense any of your rights under this Agreement, without our prior written consent. Any assignment or transfer in violation will be void. Subject to the foregoing, this Agreement will be binding upon, and inure to the benefit of the parties and their respective successors and assigns.

I hereby agree to all Additional Provisions {11} amended to this document. Additional Provisions grant the guest to special permissions or events.

4 - Payment Method

4.1 - By Checks:  Make payable to Cygnus Real Estate - No Cash Accepted. Do not mail checks within 30 days of Check-In.

  • Mail to: Cygnus Real Estate — PO BOX 991 — Suttons Bay, MI 49682.

4.2 - By PayPal:  Send cash using your paypal account with funds. Use Friends & Family and send to brokers.mi@cygnusrealestate.com.

4.3 - By Credit Card:  Pay online using VRBO's trusted and secure website.

5 - Payment Schedule

  • 25% of the Rent and Fees are due when booking 60 days in advance of Check-In.
    This amount is a Booking Deposit which holds your reservation and is applied to the Rent due.
  • 100% of the Rent and Fees are due when booking within 60 days of Check-In.
  • It is recommended paying via VRBO. When booking and paying via VRBO, use VRBO’s automated payment schedule, otherwise use the schedule below.
  • Only use the dates below when paying by check or PayPal. The Rent Final Payment is due:

    • For May Rental - Due March 15th
    • For June Rental - Due April 15th
    • For July Rental - Due May 15th
    • For August Rental - Due June 15th
    • For September Rental - Due July 15th
    • For October Rental - Due August 15th

6 - Charge Policy

If a Damage Deposit was paid, it will be returned within 15 business days after departure, providing no damage or loss, and excess cleaning is not required. Note that all guests will be responsible for all damage or loss. We reserve the right to charge guests for damage or cleaning in excess of the Damage Deposit and Cleaning Fee amount. Returned deposits are made by check via postal mail.

In order to return a Damage Deposit, you must provide a return postal address prior to Check In. You agree that failure to provide a return postal address prior to Check In releases your claim to Damage Deposit.

You agree to pay the following fee if any given event is met. Fees may be applied to a Damage Deposit. If there is no Damage Deposit you will be billed.

  • $50 - For each lost or damaged towels, linens or pillows.
  • $50 - For each lost or damaged outdoor chair.
  • $200 - For each lost or damaged outdoor table.
  • $100 - Change in reservation date.
  • $100 - For lost or unreturned rental key.
  • $150 - For impeding trash pickup.
  • $300 - For each dog that was not approved or no upfront pet fee paid.
  • $500 - For smoking/tobacco use within the rental or on its grounds.

7 - Cancellation Policy

You agree to the following terms and conditions.

  • Reservations canceled prior to 180 days before Check-In will be given a full refund minus a $250 rebooking fee.
  • Reservations canceled between 180 to 90 days before Check-In will be given a refund minus the Booking Deposit.
  • Reservations canceled within 90 days of Check-In will be not provided with any refund.
  • Any payments made with a credit card will be refunded, if allowed, less any merchant fees.
  • Refunds/Deposits are disbursed by check only via USPS, 15 business days after cancellation/check-out. Call 231.994.3556 for questions about your deposit.

8 - Mandatory Liability Release and Indemnification

On the date set out below, intending to be legally bound hereby, the undersigned (“Guest”), on behalf of him/herself and all other guests and invitees of Guest, agrees and does hereby release from liability and forever discharge (“Owner”), and all successors, assigns, members, officers and directors of any of the foregoing (all collectively as “Owner”) from any and all liability for personal injuries and property losses or damage, occasioned by, or in connection with any activity or accommodations at Owner’s property at the address herein, doing business as (“Cottage Name”). Guest further agrees to indemnify, hold harmless, and defend, Owner, in the event of any claim against Owner as defined, by Guest or any guest or invitee of Guest, or any other person claiming against or through Guest or any guest or invitee of Guest. This Release applies and extends to all boating or boat dockage, water or waterfront, or other recreational activities, and to any vehicle, trailer, or other personal property.

9 - Legal Advisory

Michigan law establishes rights and obligations for parties to rental agreements. This agreement is required to comply with the Truth in Renting Act. If you have a question about the interpretation or legality of a provision of this agreement, you may want to seek assistance from a lawyer or other qualified person.” MCL 554.634.

10 - Acknowledgement
